Terms of Use

1. ACCEPTANCE OF TERMS

By accessing and using the websites westside.tv westside.tv (collectively, "Platform"), their mobile applications (Android and iOS) and associated services, including live radio and TV broadcasting, the gamification system "Skip-the-Line" (Truva/Destruva), the live chat, and the Artist Portal, you agree to these Terms of Use.

If you do not agree with any of these terms, we ask that you discontinue use of the Platform immediately.

The Platform is operated by RADIO WEST SIDE LTDA, registered under CNPJ No. 60.420.258/0001-79, headquartered at QD SCN QD 4 S/N, Ed. Varig, Asa Norte, CEP 70714-020, Brasília/DF, Brazil.

2. REGISTRATION AND USER ACCOUNT

2.1 Account types

Listener: registration via email/password or Google Sign-In. Provides access to chat, scoring system, ranking, and Skip-the-Line voting.
Artist: registration subject to identity verification (CPF for Brazilian nationals or equivalent document for international users) and email confirmation via OTP code. Enables music submission and artistic profile management.

2.2 User responsibilities

Provide truthful, up-to-date, and complete information during registration;
Keep access credentials (password) confidential;
Not share your account with third parties;
Immediately notify Westside Radio of any unauthorized use of your account.

2.3 Account termination

You may request the deletion of your account at any time through the "Danger Zone" section in your profile, as provided under the LGPD (Art. 18). Your data will be anonymized and your points and contributions to the ranking will be preserved anonymously.

3. SERVICES OFFERED

3.1 Live broadcasting

Westside Radio offers 24/7 live broadcasting of curated musical and audiovisual content. Service availability is subject to scheduled maintenance and occasional technical interruptions, for which we shall not be held liable.

3.2 Gamification system ("Skip-the-Line")

Truva: allows a song to be promoted in the playback queue, giving it priority playback;
Destruva: reduces a song's score in the queue, pushing it down in the playback order.

Points ("Eterna Points") and free truvas are accumulated automatically based on active listening time (100 minutes = +1 point + 1 free truva). Westside Radio reserves the right to modify the scoring rules at any time.

3.3 Live chat

The live chat is available to registered users. Messages are public, visible to all participants, and actively moderated. Offensive, discriminatory content, spam, harassment, or content that violates applicable law may result in suspension or banning of the account. All users have access to reporting and blocking tools directly in the chat interface (see Section 9).

3.4 Artist Portal

Artists may submit music (MP3) and request corrections and participation claims through the administrative panel. Each submission is reviewed by the radio's curation team within 72 hours. Westside Radio reserves the right to reject any material without justification.

4. PAYMENTS (PIX)

Certain features (Premium Truva via PIX) are subject to payment processed through Mercado Pago. When making a payment:

Financial data is processed exclusively by Mercado Pago in accordance with its own terms;
Westside Radio does not store credit card data or banking information;
Refunds are subject to the Mercado Pago refund policy;
Payment confirmation is automatic via webhook and results in immediate execution of the service (Truva/Destruva).

5. AUDIOVISUAL CONTENT AND COPYRIGHT

5.1 Videos and clips

Music clips displayed on the Platform are official reproductions embedded via YouTube iframe (YouTube Embedded Player), in compliance with the YouTube API Terms of Service. Westside Radio does not host, store, copy, or redistribute music clips or videos on its servers.

5.2 Music (audio)

Westside Radio exclusively hosts audio files in MP3 format, duly curated and reported to ECAD (Escritório Central de Arrecadação e Distribuição) via automated integration with ACRCloud. The radio station is an active contributor to ECAD and operates in full compliance with Brazilian copyright law.

5.3 Artist submissions

By submitting content through the Artist Portal, the artist represents and warrants that they are the holder of the copyright, neighboring rights, phonographic rights, image rights, voice rights, artist name rights, and all other necessary authorizations, or hold express authorization from the respective holders, labels, producers, authors, performers, and other participants.

The artist grants Westside Radio a non-exclusive, worldwide, royalty-free, revocable license under the terms of this section and for the period necessary for the operation of the Platform to store, reproduce, transmit, publicly perform, make available, display, communicate to the public, technically adapt, format, transcode, and promote the submitted material on radio, TV, web, applications, smart TVs, social media, newsletters, media kits, public pages, rankings, playlists, editorial campaigns, app stores, marketplaces, CDNs, search tools, aggregators, analytics partners, infrastructure providers, and other official or contracted channels of the Platform.

The license includes, when necessary for promotion and accessibility, the creation and use of cuts, previews, teasers, clippings, thumbnails, covers, metadata, cards, captions, transcriptions, translations, dubbing, voice-over, localized descriptions, screenshots, press materials, and format adaptations, always linked to the promotion, curation, distribution, security, accessibility, internationalization, or operational documentation of Westside Radio.

Westside Radio may sublicense the content only to providers, operators, platforms, app stores, distribution networks, technical partners, affiliates, auditors, moderators, curators, legal counsel, and service providers necessary to host, protect, measure, translate, promote, distribute, or monetize the Platform, without transferring the artist's ownership. Any premium exploitation, synchronization, standalone sale, dedicated sponsored campaign, non-operational third-party licensing, specific DRM, exclusive window, or additional territorial restriction shall be subject to a complementary contract, authorization, or applicable commercial policy.

Content removal may be requested by the artist through official channels. Following verification of ownership and the absence of legal, contractual, regulatory, anti-fraud, security, billing, auditing, ECAD, or rights dispute obligations, Westside Radio will remove the content from controlled surfaces within a reasonable operational timeframe. Residual copies in cache, backups, logs, reports, publications already distributed to third parties, historical clippings, analytics, moderation evidence, and accountability obligations may remain for the strictly necessary period. Removal does not affect legitimate uses made prior to the request.

The artist is responsible for disclosing territorial restrictions, samples, participations, co-authorships, contracts with labels, publishers, distributors, collective management societies, content ratings, sensitive content, and limitations on translation, dubbing, clipping, or thumbnailing prior to making content available. In the absence of such information, Westside Radio may treat the content as suitable for non-exclusive international distribution on official channels, without prejudice to removal or adjustment upon valid notice.

6. REFERRAL SYSTEM

The referral program allows users to invite new listeners through a personalized link. Upon registration through a valid link, both parties (referrer and referee) receive bonus points according to the current rules. The following is prohibited:

Self-referral (using your own link to create another account);
Creating fake accounts to accumulate referral points;
Any attempt to manipulate the referral system will result in a ban.

7. USE OF GOOGLE SIGN-IN

Authentication via Google Sign-In is optional and uses the Google Identity Services platform. By choosing this login method:

We access only your name, email, and public Google profile picture;
We do not access your Google password, contacts, calendar, or any other data;
You may revoke access at any time in your Google account security settings;
Data received is processed in accordance with our Privacy Policy.

8. NATURE OF PLATFORM CONTENT

Westside Radio is a musical and audiovisual entertainment platform that aggregates online content from various sources (proprietary collection, YouTube, news feeds, and artist contributions). Due to the diverse nature of this content, the user acknowledges and agrees that:

8.1 Violence

Certain musical works, music videos, or journalistic materials displayed on the Platform may contain references to or visual depictions of violence, including in song lyrics, album covers, music videos, or news feed reports. Westside Radio does not produce this content directly, but curates and makes it available in compliance with applicable content ratings.

8.2 Sexuality

The Platform may feature content with references to or visual depictions of a sexual nature, including lyrics with sexually explicit content, music videos with suggestive scenes, and album covers with adult themes. All content is curated by the editorial team and presented in the artistic-musical context of the programming.

8.3 Language

Music programming and user-generated content in the live chat may contain offensive language, profanity, and expressions of a sexual nature. Although moderation actively works to maintain a respectful environment, the live nature of the platform makes it impossible to exercise prior control over all real-time interactions.

8.4 Controlled substances

Certain musical and audiovisual works available on the Platform may contain references to illicit or recreational drugs, particularly in song lyrics and music videos. Such references are part of the original artistic content and do not represent endorsement, promotion, or encouragement of the use of controlled substances by Westside Radio.

8.5 News content

The Platform aggregates editorial and news content that may address sensitive topics, including violence, politics, economics, and social issues. This content is presented primarily for informational and educational purposes.

Westside Radio recommends that users under the age of 16 use the Platform under the supervision of parents or legal guardians.

9. MODERATION, REPORTING, AND BLOCKING

9.1 Content moderation

All user-generated content on the Platform (chat messages, live interactions) is actively moderated. Westside Radio employs a combination of automated tools and human review to ensure compliance with these Terms of Use and with applicable law.

9.2 Reporting tool

All users may report messages or behaviors they consider inappropriate, offensive, or illegal. Reports may be submitted:

On the mobile app: by long-pressing the message and selecting "Report";
On the website: through the context menu available on each chat message;
By email: by sending a message to dpo@protectdata.com.br with the subject "Content Report".

All reports are logged and reviewed by the moderation team within 48 business hours. The reporter will receive confirmation of receipt of the report.

9.3 Blocking tool

Users may block other users to hide their messages and interactions. Blocking is immediate, persistent, and may be reversed at any time by the user. When blocking a user:

Messages from the blocked user will no longer appear in your chat;
The block is stored locally on your device and persists between sessions;
The blocked user is not notified about the block.

9.4 Moderation actions

Based on reports received and content analysis, Westside Radio may apply the following measures, without prior notice:

Removal of specific messages or content;
Formal warning to the offending user;
Temporary suspension of access to chat or the Platform;
Permanent banning of the account;
Reporting to competent authorities, where applicable.

10. USER CONDUCT

By using the Platform, you agree NOT to:

Post offensive, defamatory, discriminatory, threatening, or illegal content in the chat;
Engage in harassment, bullying, stalking, or intimidation of other users;
Share sexually explicit, pornographic content or content that exploits minors;
Promote the use of illicit drugs, violence, self-harm, or illegal activities;
Use hate speech based on race, ethnicity, religion, gender, sexual orientation, or disability;
Use bots, automated scripts, or manipulation techniques to obtain points or votes;
Attempt to access other users' accounts or internal Platform systems;
Interfere with live broadcasting or streaming services;
Violate third-party intellectual property rights;
Collect personal data of other users without consent;
Create fake accounts or impersonate another person (impersonation);
Send spam, chain messages, pyramid schemes, or unauthorized commercial content.

Violations may result in temporary suspension, permanent banning, or applicable legal measures, as described in Section 9.4.

11. INTELLECTUAL PROPERTY

All original content on the Platform (design, interface, texts, logos, visual identity) is the exclusive property of RADIO WEST SIDE LTDA or its licensors. Reproduction, distribution, or commercial use without prior written authorization is prohibited.

12. COOKIES

The Platform uses essential cookies for functionality (session, language) and analytical cookies. By accepting the cookie banner, you consent to their use as described in our Privacy Policy. You may manage cookies in your browser settings.

13. LIMITATION OF LIABILITY

Westside Radio does not guarantee uninterrupted availability of the live broadcast;
Although active moderation is maintained, we are not fully liable for user-generated content in the real-time chat;
We shall not be liable for losses resulting from technical interruptions or maintenance;
Gamification services have no monetary value and cannot be redeemed for cash;
Curated musical and audiovisual content may contain adult themes (violence, sexuality, language, and substance references), and it is the responsibility of the user or their legal guardians to assess the suitability of the content.

14. PRIVACY AND DATA PROTECTION

The processing of personal data strictly complies with the Brazilian General Data Protection Law (LGPD — Law No. 13,709/2018). For full details, please refer to our Privacy Policy.

15. MODIFICATIONS TO TERMS

Westside Radio reserves the right to modify these Terms of Use at any time. Significant changes will be communicated through the Platform. Continued use after publication of the changes constitutes acceptance of the new terms. The most recent version will always be available at westside.tv/termos-de-uso.

16. GOVERNING LAW AND JURISDICTION

These Terms of Use are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be resolved in the courts of the Judicial District of Brasília/DF, to the exclusion of any other, however privileged it may be.
