1. COMMITMENT TO INTELLECTUAL PROPERTY

Westside Radio takes Intellectual Property matters very seriously and is committed to meeting the needs of copyright holders by helping them manage the publication of their content online.

Westside Radio is a live entertainment platform that operates as an audiovisual content portal. We do not host third-party videos on our servers — we exclusively use the YouTube Embedded Player (YouTube API) for embedding videos from authorized official channels, in full compliance with the YouTube API Terms of Service and YouTube's Content Policy.

Regarding audio content, Westside Radio maintains a curated music library that is duly reported to ECAD (Escritório Central de Arrecadação e Distribuição), serving as an active contributor to the Brazilian copyright system. Track identification is performed in partnership with ACRCloud.

2. THIRD-PARTY CONTENT

Any content displayed through embedded third-party players (embeds) is the sole responsibility of the website or platform that hosts the original content. Westside Radio has no knowledge of whether the content on the third-party site is or is not authorized by the copyright holder, this being a matter exclusively between the site hosting the content and the rights holder.

Westside Radio does not host any third-party audio or video content on its servers or network.

3. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) — §512

Westside Radio is a pro-DMCA platform. In compliance with the Digital Millennium Copyright Act of 1998 (the text of which may be found at the U.S. Copyright Office website at www.copyright.gov), Westside Radio will respond promptly to notices of copyright infringement reported to our Designated Agent identified below.

Copyright holders may use the DMCA protocol to request the removal of links to content they believe infringes their rights. It should be noted that the removal of a link from Westside Radio does not remove the original content hosted by the third-party site. The rights holder must contact the site hosting the content directly to request removal at the source.

4. NOTIFICATION PROCEDURE (TAKEDOWN REQUEST)

If you are a copyright owner, or are authorized to act on behalf of the owner of an exclusive right under copyright, and believe that your work has been copied in a manner that constitutes copyright infringement, please submit your notice to our Designated Agent with the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
  3. Evidence of copyright ownership or evidence that you are an authorized representative of the rights-holding entity;
  4. The date of original publication or registration of the work;
  5. The date the infringement was discovered;
  6. The specific URL containing the allegedly infringing content (format: https://westside.tv/...);
  7. Contact information sufficient to permit Westside Radio to contact the complaining party, including name, address, telephone number, and, if available, email address;
  8. A statement of good faith that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  9. A statement, under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

5. COUNTER-NOTIFICATION

If you believe that your content was removed in error, you may submit a counter-notification to our Designated Agent containing:

  1. Your physical or electronic signature;
  2. Identification of the content that was removed and the URL where it was available prior to removal;
  3. A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located.

6. REPEAT INFRINGER POLICY

In accordance with the DMCA and other applicable laws, Westside Radio has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed repeat infringers. Westside Radio may also, at its sole discretion, limit access to the website and/or terminate the accounts of any user who infringes any intellectual property rights of third parties, regardless of whether there is repeat infringement.

7. INTERNATIONAL LEGISLATION

In addition to the DMCA, Westside Radio acknowledges and respects the following international copyright and intellectual property protection laws:

  • Law No. 9,610/1998 (Brazil): Brazilian Copyright Law, including reporting obligations to ECAD;
  • Directive 2001/29/EC (European Union): Directive on the harmonization of certain aspects of copyright and related rights in the information society;
  • Copyright Act (Canada): Canadian copyright legislation, including notice-and-notice provisions;
  • Berne Convention: International treaty for the protection of literary and artistic works.

All copyright infringement notifications regarding this platform must be sent to the Designated Agent of Westside Radio:
